Terms of Service

These Terms of Service ("Terms") govern access to and use of the website, AI receptionist service, and related add-on services (collectively, the "Services") provided by NewMynd ("NewMynd," "we," "us," or "our"). By requesting a demo, signing up for, or using the Services, you ("Customer," "you") agree to these Terms.

1. The Services

NewMynd provides an AI voice receptionist that answers calls, books appointments, and answers common questions on behalf of your business, configured to your services, hours, and booking flow. Optional add-on services — AI websites, AI-powered ads, and AI systems and automation — may be purchased separately once your account is active.

2. Accounts and Onboarding

You agree to provide accurate business information (services, hours, booking flow, and contact details) so we can configure your AI receptionist correctly. You're responsible for keeping that information current — outdated configuration can lead to missed or incorrect bookings, and NewMynd isn't liable for outcomes caused by inaccurate information you provided.

3. Billing and Payment

Every engagement starts with a free, no-commitment live demo — you are not charged anything until you activate a subscription. Once activated, Services are billed at a flat monthly rate agreed upon during onboarding, charged in advance via our payment processor (Stripe) on the same day of the month as your activation date. By providing payment details, you authorize NewMynd to charge your payment method on this recurring basis until the subscription is cancelled as described below.

4. Minimum Term, Cancellation & Refunds

Subscriptions carry a minimum initial term of 3 months from the activation date, to cover onboarding and configuration work. During this minimum term, monthly charges are non-refundable, including if you choose to stop using the Services before the term ends.

After the 3-month minimum term, you may cancel at any time by emailing support@newmynd.io with your business name and a cancellation request — we confirm all cancellations by email within one business day. Cancellation takes effect at the end of your current billing period: your AI receptionist stays active through the period you've already paid for, and you will not be charged again afterward.

We don't offer refunds or credits for partial months, whether you cancel mid-cycle or stop using the Services without formally cancelling. Charges already processed for the current billing period are final, except as required by law. If your AI receptionist experiences an extended outage or misconfiguration caused by NewMynd, contact support@newmynd.io — we review these on a case-by-case basis and may issue a partial credit at our discretion.

AI Websites, AI-Powered Ads, and AI Systems & Automation are scoped and billed separately from the AI Receptionist subscription. Refund terms for these engagements are agreed to individually at the time of purchase.

5. Acceptable Use

You agree not to use the Services to:

Violate any applicable law or regulation, including telemarketing and consumer-protection laws
Send unsolicited or misleading communications through the AI receptionist
Interfere with or disrupt the integrity or performance of the Services
Attempt to reverse-engineer or resell the Services without our written consent

6. Third-Party Services

The AI receptionist is built on third-party voice-AI infrastructure (including Retell AI) and may rely on other third-party providers for telephony, scheduling, or payments. Your use of the Services is also subject to those providers' applicable terms, and NewMynd isn't responsible for outages or issues originating from third-party providers.

7. Intellectual Property

NewMynd retains all rights, title, and interest in the Services, including underlying software, configurations, and documentation. You retain ownership of your business data and content you provide to us for configuration purposes.

8. Disclaimer of Warranties

The Services are provided "as is" without warranties of any kind, express or implied, including fitness for a particular purpose. AI-generated responses may occasionally be inaccurate; we recommend reviewing call logs and booking confirmations regularly.

9. Limitation of Liability

To the maximum extent permitted by law, NewMynd's total liability arising out of or related to the Services will not exceed the amount you paid us in the three months preceding the claim. NewMynd is not liable for indirect, incidental, or consequential damages, including lost revenue or missed bookings.

10. Termination

We may suspend or terminate access to the Services for breach of these Terms, non-payment, or misuse. You may cancel at any time after your minimum term as described in Section 4 above.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated to the email on file, and continued use of the Services after changes take effect constitutes acceptance.
